This opposition has taken place as there have been numerous arguments questioning the expertise of the USPTO (United States Patent and Trademark Office) in evaluating software inventions. However, software patents play an important role in today's world of technology and invention as the protection of the software innovation has become very crucial. Software products come with a huge economical growth and development.
Software patents definitely intervene with the modernization and competition, but it is the right of the inventor of the software to safeguard his invention and restrict its use to anyone else. More use of software patents has optimized the scope in the field of innovation and invention.
This is so as the software patenting restricts the copying of that software by anyone else hence encouraging the other people to develop their own software for their usage. On the other hand, replicating an invention or software is very easy, economical and fast. That is why the software replication is a common business among various nations of the world leading to a lower innovation rate in those countries.
Innovation can definitely be stopped due to a bad patent. This is so as the bad patent secures more than the originally invented software by its owner. Bad patent proves a threat because it safeguards even the general information and solutions of software and provides the inventor with all of the software rights even if this is not present in the patent claim or planned by the inventor. The suppression of innovations and inventions occurs due to incorrect development and usage of the software patents.
